The Sanity Clause

What is an  Amnesty Clause?
The Amnesty Clause is a clause negotiated into the newly ratified NBA Collective Bargaining Agreement between the players and owners which allows a team to release one player from their roster and be free of any financial obligations to that player.  This was added to allow teams to clear salary cap space in preparation for new salary cap rules.  A player who is released under this program is said to be “amnestied.”

This is the second time an NBA CBA has included an Amnesty Clause.  Each team is only allowed to amnesty one player for the entire period of the CBA, and must select a player to be amnestied before the start of the season.  There is belief among basketball experts that such a rule is put in place by the owners to rid themselves of bad contracts that they had previously signed.  The original rule was sometimes called the “Allen Houston” because the New York Knicks had signed Allen Houston to a $100M contract that was untenable based on his performance.

Hey we need this in baseball, and it should be called the Sanity Clause..

Are you kidding me, you think we have outcry over Trump  winning the POTUS, watch  all  the small market thieving  owners in MLB come out against  any Amnesty Clause an MLB CBA would entertain

At the moment MLB’s king pin Rob Manfred and his legion of white collar criminals have managed to knee cap  all  the big market teams with a 5 year CBA Lux Tax penalty that  could easily kick to 50%, and in extreme cases 90% by teams compiling multiple infractions, (see the Yanks and Dodgers)


In a way throwing a soft cap into  the MLB mix is  a good thing, or we’d have another NBA where in August you already know Cleveland and San Francisco  are gonna punch it out for the NBA Championship in June..

If the Red Sox weren’t facing a third consecutive Tax Penalty, and quickly approaching a 40% hit, not only would they have traded for Chris Sale, but probably would have given Encarnacion a $100M contract to  replace Grand Papi Ortiz…

Thankfully they  acquired Mitch Moreland to  help shore up  first base / DH and not Eddie.. Moreland is a good defensive player, and teams might get  frustrated by Boston’s porous defense, but I can  guarentee nobody is staying up late in the video  room worrying about how to pitch to Mitch Moreland

Anyway Sensie Joel Sherman, inspired by returning gifts on Monday December 26th, mused what player on each team  would you want to  return, if you could?

The most over-valued player on the Yanks is hands down Jacoby Ellsbury.. His bank account digits and his baseball numbers don’t match  up

The accountants and analytics departments will value a WIN at around $6.5 / $7M per in 2016.. So on paper Ellsbury’s ceiling would be $14M per.

Now his defense is quickly diminishing, his legs will start to  betray, and except for his heroic 2011 season when he hit 32 Taters, he’s never come close to  that  total in a season..

In fact the DoughBoy has played in the friendly confines of Yankee Stadium for 3 years and  only hit 32 HR’s….I’d like to  ask  Cashman if he researched Ellsbury’s 2010 injury recovery records?

And did he track his 2011 season RE: did he have a medical prescription for some form of HGH? Or did he just look at the numbers which are an  extreme outlier… Ellsbury secured a 7 yr $153M contract off of 1 great 2011 season

Ellsbury’s 2014 season, his first  as a Yankee was his best

At the moment if he could start  to  at least duplicate his 2014 campaign and the Yanks ate some money they might be able to  flip  him ?

As far as Joel Sherman  having to  return  a gift on the day  after Christmas, or at  all, dummy

You gotta do  what I do Sensie, take my wife…..I wrap the receipt as a gift .. The package(s) are just placed in her car  for immediate return from whence they came

As for me,  nobody gives me nothing, and I don’t give anybody nothing in return, it’s a clean  deal from top  to  bottom…

    • Cashman goes on to tell Sherman why they spent so much on Chapman and Holliday, because the ticket prices in NY are so steep they have to put brand names on the field….

      in 2014 Hal sent the yanks back 5 yr’s by signing McCann Ellsbury and Beltran, here’s a thought, make the ticket prices less expensive while the Yanks build their core

      That said Chappy is a good 1 inning pitcher, and is it possible Holliday takes to NY, becomes a fan favorite and actually puts up good numbers making him a potential cheapish signing for 2018?
